The Constitution and Indian Democracy
A reader’s introduction to the constitutional framework of the Republic of India, fundamental rights, federalism and democratic government.
A Constitution created after independence
The Constitution of India was adopted by the Constituent Assembly on 26 November 1949 and came substantially into force on 26 January 1950. Its Preamble sets out commitments to justice, liberty, equality and fraternity and defines the constitutional identity of the republic. The text has been amended many times since 1950.
Union, states and local government
India is a federal union in which constitutional powers are distributed between the Union and the states, with additional roles for union territories and local government. The internal map has changed repeatedly since independence. State boundaries, languages and regional political identities are therefore important to understanding the places represented in the archive.
Rights and democratic institutions
The Constitution establishes parliamentary government, an independent judiciary, elections and fundamental rights. It also includes Directive Principles of State Policy and provisions addressing social inequality. Article 17 abolishes “Untouchability” and forbids its practice, an important legal distinction when discussing caste and contemporary society.
A living political framework
The Constitution should not be treated as a simple description of everyday reality. Constitutional ideals, legislation, political practice and lived experience can differ. Everyday Lives uses the constitutional framework to explain institutions while relying on separate evidence for claims about how communities actually live.
